ELECTRONIC FUND
TRANSFERS AGREEMENT
AND DISCLOSURE

 

Consumer Liability
Depositor ("you" or "your") has requested that
First National Bank ("Bank," "we," or "us") permit you to access an Electronic Funds Transfer (EFT) system and (if applicable) that First National Bank of Illinois issue you an automated teller card, debit card, code or other device ("Access Device") to transact on your account. By requesting, receiving, signing, using, authorizing another to use or otherwise accepting the Access Device (if applicable, and including any replacement or substitute Access Device) or the (EFT) system, you and any authorized signers, agree to be bound by the following rules and regulations:

  1. You are responsible and liable for all authorized transactions made through the use of the Access Device and for all authorized transactions made under any preauthorized transfer. All such transactions are subject to all applicable agreements, rules and regulations of First National Bank's checking accounts and savings accounts for which Access Device use or preauthorized transfers are authorized, now or in the future, as said agreements, rules and regulations are now in effect or as they may hereafter be amended, modified or adopted.
  2. You authorize First National Bank to charge your checking account(s) and saving(s) accounts for all authorized transactions resulting from the use of the Access Device or resulting from any preauthorized transfer, and you assume all responsibility and liability for all such Access Device use and preauthorized transfers.
  3. First National Bank will assign you a "Personal Identification Number" (PIN) to enable you to be identified when using the Access Device. The Access Device and the number are to be used as instructed and you agree not to disclose, in any manner whatsoever, the Personal Identification Number (PIN) to anyone other than authorized users of the Access Device.

Tell us AT ONCE if you believe your First National Bank ATM or debit card has been lost or stolen. Telephoning is the best way of keeping your possible losses down. You could lose all the money in your account (plus your maximum overdraft line of credit). If you tell us within 2 business days, you can lose no more than $50 if someone used your First National Bank ATM card without your permission. (If you believe your First National Bank of Illinois ATM card has been lost or stolen, and you tell us within 2 business days after you learn of the loss or theft you can lose no more than $50 if someone used your First National Bank ATM card without your permission.) If you do NOT tell us within 2 business days after you learn of the loss or theft of your First National Bank ATM card, and we can prove we could have stopped someone from using your First National Bank ATM card without your permission if you had told us, you could lose as much as $500.

Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the periods.

The liability of a cardholder for unauthorized use of a MasterCard-branded debit card (regardless of the type of account to which transactions initiated with such a card are posted) shall not exceed US $0 if the conditions set forth below, have been met or if the conditions set forth below have not been met, the lesser of the US $50 or the amount of money, property, labor or services obtained by the unauthorized use before notification to the card issuer.

The liability limitations set forth above shall apply only if the cardholder has exercised reasonable care in safeguarding such card from risk of loss or theft, the cardholder has not reported two or more incidents of unauthorized use to the issuer in the immediately preceding 12-month period, and the account to which transactions initiated with such card are posted is in good standing.

Business days
For purposes of these disclosures, our business days are Monday through Friday. Holidays are not included

Your Card

  • Your card remains the property of the Bank and will be surrendered immediately upon request.

  • To abide by the rules and regulations of the Bank relating to the use of your Card and the performance of any EFT services.

  • To be responsible for all authorized uses of your Card whether used at a full service automated teller machine ("ATM"), an electronic cash dispensing machine, a point-of-sale terminal, a home computer or otherwise.

  • If you use your Card to access an Account that is no longer available or lacks sufficient funds to complete the transaction, the Bank may at its sole discretion, charge or credit the transaction to another Account.
  • The Bank may cancel your Card at any time without notice.
  • The Bank has the right to refuse a transaction on your Account when your Card has been reported lost or stolen or if the Bank reasonably believes there is unusual activity on your Account.
  • You cannot use your Card for a transaction that would exceed your Account balance plus the available credit on any overdraft line of credit attached to your Account. The Bank will not be required to complete any such transaction or any transaction that would exceed the daily authorization limit attached to your Card, but if it does, you agree to pay the Bank the amount of the improper withdrawal or transfer upon request.

Transfer types and limitations
E-Checking transactions may occur.

  1. Account access - You may use your First National Bank ATM /Debit card to:
  • Withdraw cash
  • Check account balances
  • Transfer funds between your designated account(s)
  • Make cash withdrawals or balance inquiries using another bank’s ATM, if it is a Cirrus or Cash Station member
  • ATM: Pay for purchases up to $400 per day at merchants that have agreed to accept the card
  • DEBIT CARD: Pay for purchases up to $1,000 per day at merchants that have agreed to accept the card
  • Some of these services may not be available at all terminals

24 Hour Bankline is activated upon account opening unless declined. You may use the 24 Hour Bankline to:

  • Check account balances
  • Transfer funds between your designated account(s)
  • Verify check clearings

Internet Banking - is activated upon account opening unless declined. You may use Access Online to:

  • Check account Balances
  • View current transactions
  • View account statements
  • View Check Images
  • Transfer funds between your designated accounts
  • Place a stop payment ($30.00 per item stopped)

User Codes and passwords are case-sensitive, (meaning the system recognizes both upper and lowercase characters) and may be alphanumeric as long as they are 6 to 13 characters long. User Codes and passwords can contain no spaces.

You will be prompted to change your password at least every 90 days.  You must access your account at least once every thirty days or your account(s) will become disabled.  If your account(s) becomes disabled you may contact us at 708-474-1300.

To change your password, once you are logged into the Internet banking system, click on "Password" and follow the directions.

 (2) Limitations on frequency of transfers -

  • You may make only 10 debit POS transactions each day
  • If you have a savings or money market account, you may make no more that 6 preauthorized transfers and withdrawals to another account of yours at the Bank or to a third party. No more than 3 of these transfers may be made by your check, draft, debit card or similar order that is payable to a third party.
  • You may arrange with others in writing for preauthorized transfers (i.e. direct deposit into your account of payroll, Social Security, or pension benefit checks – or for the automatic payment from your account of utility bills, insurance premiums, or mortgage payments.

(3) Limitations on dollar amounts of transfers -

  • You may withdraw up to $1,400 daily (ATM and/or Debit POS) from our terminals each day with your First National Bank of Illinois ATM/Debit card.

Fees
You will be charged for each transaction/transfer as disclosed on the Schedule of Fees and Charges.To obtain a Schedule of Fees and Charges you may contact us at 708-474-1300.  When you use an ATM not owned by us, you may be charged a fee by the ATM operator or any network used and you may be charged a fee for a balance inquiry even if you do not complete a fund transfer.

Confidentiality
We will disclose information to third parties about your account or the transfers you make:

  • Where it is necessary for completing transfers, or
  • In order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant
  • In order to comply with government agency or court orders
  • As permitted by law, to companies that perform marketing services on our behalf and with other financial institutions with whom we have joint marketing agreements
  • If you give us your written permission

Documentation
(1) Terminal transfers - You can get a receipt at the time you make any transfer to or from your account using one of our First National Bank Automated Teller Machines (ATM) or point-of-sale terminals

(2) Authorized credits - If you have arranged to have direct deposits made to your account at least once every 60 days from the same person or company, you can call us at 708-474-1300 to find out whether or not the deposit has been made

(3 Periodic statements - You will get a monthly account statement if you have a checking account - If you have a savings account, you will get a monthly statement, unless there are no transfers in a particular month. In any case, you will get a savings account statement at least quarterly - These statements will show electronic transfers to or from your account

(4) Passbook account where the only possible electronic fund transfers are preauthorized credits – If you bring your passbook to us, we will record any electronic deposits that were made to your account since the last time you brought in your passbook

Preauthorized Payments
(1) Right to stop payment and procedure for doing so - If you have told us in advance to make regular payments out of your account, you can stop any of these payments. Here's how:

Call or write us at the number(s) or address listed on the first page of this document in time for us to receive your request 3 business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within 14 days after you call. You will be charged for each stop-payment order you give, as disclosed on the Schedule of Fees and Charges.

(2) Notice of varying amounts - If these regular payments may vary in amount, the person you are going to pay will tell you, 10 days before each payment, when it will be made and how much it will be. You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set

(3) Liability for failure to stop payment of preauthorized transfer - If you order us to stop one of these payments 3 business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages.

Financial Institution's Liability
If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions.

We will not be liable, for instance:

  • If, through no fault of ours, you do not have enough money in your account to make the transfer
  • If the transfer would go over the credit limit on your overdraft line
  • If the automated teller machine where you are making the transfer does not have enough cash
  • If the terminal was not working properly and you knew about the breakdown when you started the transfer
  • If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken
  • There may be other exceptions stated in our agreement with you

Initial and annual error resolution notice
In case of errors or questions about your electronic transfers, call or write us at the number(s) or address listed on the front page of this document as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared.

  • Tell us your name and account number (if any)
  • Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information
  • Tell us the dollar amount of the suspected error

If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.

We will determine whether an error occurred within 10 business days (20 business days for new accounts) after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days (90 days for point of sale or new accounts) to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account.

We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.

All deposits, payments, and transfers made through the use of your Access Device or by a preauthorized transfer are subject to proof and verification by First National Bank. Deposits made after our cut-off time will be credited the following business day.

Bank may amend, modify or rescind these rules and regulations at any time upon its taking one or both of the following steps, except that in instances listed in (1) only the procedure in (1) will be used:

(1) Mailing or delivering written notice of such amendment, modification or rescission to you at least 30 days prior to the effective date of any such change if the change would result in increased fees or charges, increased liability to you, fewer types of available electronic fund transfers, or stricter limitations on the frequency or dollar amount of transfers

(2) Posting a copy of such amendment, modification, or rescission adjacent to the place assigned for the use of the automated teller machines or other electronic banking devices for a period of 30 days

First National Bank of Illinois may, at its option, mail or deliver written notice to you of any amendment, modification or rescission other than those described in (1) above, but without the requirement that notice be mailed or delivered at least 30 days prior to the effective date of any such change.

Any amendment, modification, or rescission made in the manner described above shall be binding upon you as though expressly agreed to by you. In the event that a written notice is mailed to you, it shall be mailed to your last known address as shown on Bank's records.

Notwithstanding the provisions of this paragraph, First National Bank may terminate this agreement at any time, in the event that First National Bank terminates your account(s). In the event that such action is taken by First National Bank, First National Bank will notify you in writing within 30 days of the date Bank takes such action.

You agree that this Agreement and Disclosure shall be subject to and governed by all applicable state laws and any applicable laws of the United States.

Termination
The Bank may terminate access device, in whole or in part, at any time without prior notice. If you or the Bank cancels this agreement you must surrender this card or any other access device issued to you.

Safety
For your safety, please remember the following tips when you use any Automated Teller Machine, particularly after dark:

(1) Park in or near a well-lighted area.

(2) Observe the area for suspicious persons or activity, preferably from your car, before beginning your transaction. If you see anyone or anything suspicious, you may wish to use another Automated Teller Machine or delay your transaction.

(3) Have someone accompany you.

(4) Pocket your cash quickly and count it later in a safe place. Never make a display of your cash.

Cancel your transaction, remove your card, and leave the area immediately-even in the middle of a

transaction, if you become concerned for your safety.
